The electronic patient file and liability for related damages and dangers

Electronic Patient File, E-Health

In their technical contribution, the two authors first give an overview of the electronic patient file and its implementation, as well as of the persons and institutions involved, before discussing possible cases of damage and analysing concrete legal relationships in more detail. They conclude that the existing liability standards provide at least conceptually sufficient compensation rules for cases of damage and that no new legal provisions are required.

The German article was published in "Jusletter IT Flash" on 26 April 2018 and is available online here. If you have any legal questions in connection with the electronic patient file, please do not hesitate to contact us.
