Digital data as economic good: digital data as chattel (movable legal objects)

In the digital economy digital data is being produced, transferred and traded like commodities. Digital data has become a commercial good of the daily business. Amazingly enough, there is still an absence of a clear legal basis for digital data. What is digital data? Based on the dealing with digital data in the economy and in order to distinguish digital data from personal data and intellectual property, Martin Eckert comes in his editorial in the SJZ (Schweizerische Juristen-Zeitung) to the conclusion that digital data fulfil the characteristic requirements of chattels and therefore can be the object of property law (res digitalis).
